1. Acceptance of Terms

By accessing our website, requesting an estimate, or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services. We may update these Terms from time to time as described in Section 9.

2. Our Services

CJ Landscaping provides residential and commercial landscaping services across Denver and the Front Range, including Denver, Arvada, Westminster, Thornton, Golden, and Broomfield. Our services include landscape design, hardscape construction (such as patios, pavers, and retaining walls), and landscape maintenance. We also provide estimates and quotes for prospective work.

3. Estimates & Quotes

Any estimate or quote we provide is for planning purposes and is non-binding until a written agreement is signed by both you and CJ Landscaping. Final pricing may vary based on actual site conditions, access, soil, drainage, scope changes, material availability, and other factors discovered during the work. We will communicate any material changes to you before proceeding.

4. Payment & Deposits

A deposit or upfront payment is required before a project is scheduled and before any materials are ordered. The deposit reserves your place on our schedule and covers initial design, planning, and material costs. Unless your signed agreement states otherwise, the remaining balance is due upon completion of the work. For larger projects, payment may be structured in milestones — for example, a deposit to begin, a progress payment during the work, and a final payment on completion. Accepted payment methods and the exact schedule are set out in your estimate or agreement. Past-due balances may be subject to late fees and reasonable collection costs.

5. Cancellations & Refunds

You may cancel a scheduled project before work begins. In that case we will refund your deposit, less any costs we have already incurred on your behalf — such as custom-ordered materials, design work, permits, or equipment rental.

Once work has begun, all payments and deposits are non-refundable. Landscaping materials are frequently custom-ordered, and labor and equipment are committed specifically to your project, so they cannot be returned or reallocated. Any change to the agreed scope after work begins (a "change order") may affect the price and timeline and will be confirmed with you before we proceed.

6. SMS / Messaging Terms

CJ Landscaping sends two categories of text messages, each requiring its own opt-in through the checkboxes on our website forms:

7. Use of Website

You agree to use our website only for lawful purposes. You may not misuse the site, including by attempting to gain unauthorized access, interfering with its operation, introducing malicious code, scraping or harvesting data, or using it in any way that could damage, disable, or impair the site or interfere with others' use of it.

8. Intellectual Property

All content on this website, including text, photos, project images, graphics, logos, and the CJ Landscaping name and branding, is owned by or licensed to CJ Landscaping and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or use our content without our prior written permission.

9. Disclaimers & Limitation of Liability

Our website and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including any warranties of merchantability or fitness for a particular purpose.

Plant material and results. We install healthy plant material, but plant survival and growth depend on weather, soil, watering, and ongoing care after installation, and are not guaranteed unless a specific plant warranty is stated in your signed agreement. Any such warranty requires that you follow our care instructions.

Underground utilities and lines. Before excavation we request public utility locates (811). You are responsible for identifying and marking private or unmarked underground lines — including irrigation and sprinkler systems, low-voltage lighting, invisible pet fences, and utilities running to detached structures. CJ Landscaping is not liable for damage to private or unmarked lines.

Site conditions and access. You are responsible for disclosing known hazards and for providing safe, clear access to the work area. We are not responsible for pre-existing conditions, drainage or grading issues outside the agreed scope, or damage arising from conditions we could not reasonably have discovered.

Timelines and weather. Start dates and completion timelines are good-faith estimates and may be affected by weather, ground conditions, material availability, or other events beyond our reasonable control. We are not liable for delays caused by such factors.

Limitation of liability. To the fullest extent permitted by law, CJ Landscaping's total liability for any claim arising out of our work or your use of our website will not exceed the amount you paid for the specific services giving rise to the claim, and we will not be liable for any indirect, incidental, special, or consequential damages. Nothing in these Terms limits rights or remedies set out in a signed service agreement between you and CJ Landscaping.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Any dispute arising under these Terms will be subject to the jurisdiction of the state and federal courts located in Colorado.
